Patios, decking and terraces

Create an
outdoor space
you’ll love.

Patios, decking and raised terraces can often be built or extended under Permitted Development (PD) without a full planning application — giving you a great outdoor space to relax, entertain and enjoy your garden.

The key PD rules.

Patios, decking and raised terraces generally fall under the Permitted Development Order. The main limits are set by their height above ground level, their position (for example near a highway) and the effect on neighbouring properties, with additional rules for listed buildings and conservation areas.

See all the rules

The important bit:

Your patio or decking must comply with all of the relevant PD rules. If any single limit is exceeded, a normal planning application may be required.

What’s allowed?

A range of outdoor areas can often be built under PD, including:

Ground-level patioGround-level patioA paved area at the same level as the garden.
Low-level timber decking in a rear gardenDeckingA timber or composite deck, often raised slightly above ground.
Low raised paved terrace outside the back doorsRaised terraceA higher platform, often with steps, for sloping gardens.

How high can it be?

Patios and decking must not be more than 0.3 metres (30cm) above the level of the adjoining ground.

Maximum 0.3 metres above ground level

Where can it go?

Your patio or decking must usually be within the boundaries of your property and must not be forward of the principal elevation.

Materials and appearance.

Materials should be of a similar appearance to the existing house and garden setting.

Permeable block paved front driveway

Other important limits.

  • Must not be more than 0.3 metres above ground level.
  • Must not be forward of the principal elevation.
  • Must not adversely affect neighbouring properties.
  • Must comply with additional rules in conservation areas, AONBs and near listed buildings.

Permitted Development rights described on this page apply to houses in England under the Town and Country Planning (General Permitted Development) (England) Order 2015. Different planning rules apply in Scotland, Wales and Northern Ireland. This page is general guidance, not a formal planning determination — always check your own property and, where you need certainty, apply to your local planning authority for a Lawful Development Certificate.

Maximize your property’s footprint with precision and ease. Permitted provides complete design for Permitted Development Rights. Our packages are designed around the Permitted Development limits, so many projects can proceed without a full planning application.
